WAIVER AND RELEASE

WAIVER, RELEASE, INDEMNIFICATION & COVENANT NOT TO SUE

In consideration of my child’s participation in University of Hawaii Community Design Center’s Event Series, I, the parent/guardian of the minor named above HEREBY DO RELEASE University of Hawaii Community Design Center, its officers, agents, and employees from any causes of action, claims, or demands of any nature whatsoever including, but in no way limited to, claims of negligence, which I may have, now or in the future, against University of Hawaii Community Design Center on account of personal injury, property damage, death or accident of any kind, arising out of or in any way related to the use of University of Hawaii Community Design Center facilities/equipment or participation in in-person or online University of Hawaii Community Design Center programs whether that participation is supervised or unsupervised, however the injury or damage occurs, including, but not limited to the negligence of University of Hawaii Community Design Center, its officers, agents, and employees.

In consideration of the named minor’s participation in University of Hawaii Community Design Center, I, the undersigned parent/guardian of the named minor, agree to INDEMNIFY AND HOLD HARMLESS University of Hawaii Community Design Center, its agents and employees from any and all causes of action, claims, demands, losses, or costs of any nature whatsoever arising out of or in any way related to the named minor’s in-person or online University of Hawaii Community Design Center Event Series participation.

I hereby certify that I have full knowledge of the nature and extent of the risks inherent in University of Hawaii Community Design Center Event Series participation and that I am voluntarily assuming said risks. I understand that I will be solely responsible for any loss or damage, including personal injury, property damage, or death, the named minor sustains while participating in University of Hawaii Community Design Center Event Series and that by signing this agreement I hereby release University of Hawaii Community Design Center, its officers, agents, and employees of all liability for such loss, damage, or death.

I, expressly agree that this document is intended to be as broad and inclusive as permitted by the law of Hawaii and that if any portion of the document is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect. Furthermore, I expressly agree that this document shall be governed by and interpreted in accordance with the laws of Hawaii and that the courts of Honolulu county, Hawaii shall be the exclusive venue for any and all disputes relating to or arising from this document.

University of Hawaii Community Design Center Photo and Video Release:

I hereby consent to the use of 1) testimonial, 2) photographs, and/or 3) video of me or my child for publicity purposes by the University of Hawaii Community Design Center and its affiliates in print, broadcast, and electronic media (both its own and third party media outlets) as the organization deems appropriate. I understand that the University of Hawaii Community Design Center may change the format or edit said photos/testimonials for its purposes. There is no time limit on the validity of this release.
