TERMS AND CONDITIONS

Who designs Hawaiʻi is committed to each student’s success in learning within a caring, responsive, and safe environment that is free of discrimination, violence, and bullying. Who designs Hawaiʻi has been developed for educational purposes and should not be used for any commercial, political, or other purposes.

PARTICIPANT CODE OF CONDUCT:

• Listen to staff.

• Be positive and have fun!

• Respect staff and other participants.

• Participate in activities.

• Use appropriate language and behavior; no swearing, foul or demeaning language or gestures.

• Ask for help from Who designs Hawaiʻi coordinator or a supporting adult if you need it!

VIRTUAL CODE OF CONDUCT:

•  Virtual sessions will use Zoom, an online video conferencing service, to bring participants interactive design sessions. Please review the following guidelines in order to maintain a safe experience for all participants:

UHCDC coordinators will monitor the virtual session video and audio. UHCDC is not responsible for the supervision of individuals participating in virtual programs. Support and supervision by adult caregivers is required for successful virtual participation.

  • We will send you a link to join the Zoom class meeting. You will NOT need to set up a Zoom account or input any information except for the student’s first name and last initial. Please go to zoom.us for more details about the system.

  • Virtual sessions will be live and interactive. During live sessions, participants may hear and see anything within the audio and camera viewing areas. Please make all household members aware of this. Please make sure your student is in a quiet place where a parent can monitor the session. Turning the camera towards a wall can help control the area.

  • Sound and voices can be captured by your device’s microphone and heard by others in the Zoom meeting. Who Designs Hawaiʻi staff will mute participants for portions of the session, and unmute participants during discussions and to hear questions.

  • Be aware that there may be online media that contain references, ads, or links from third parties. Who Designs Hawaiʻi is not associated with those third parties.

  • Check your personal web settings to minimize ads.

  • Sharing Zoom meeting links and passwords is strictly prohibited.

  • Personally recording any Who designs Hawaiʻi session is prohibited.

  • Participant user names should not be inappropriate, offensive, or vulgar in nature and must include clearly identifiable information about the registered participant, such as first and/or last name.

  • Background images may be used, if desired, but cannot be inappropriate, offensive, or vulgar in nature and must not pose as a distraction to others in class. Who Designs Hawaiʻi staff reserve the right to disable a participant’s video, if deemed necessary.

  • Zoom Chat: Texts unrelated to the lesson are distracting to both the speaker and group, therefore use the Zoom chat feature only for texts relating to the lesson. Instructors reserve the right to disable all chat functionality, if deemed necessary.

DISCIPLINARY GUIDELINES:

Should a participant choose not to follow the agreed upon Code of Conduct, here are the Disciplinary Guidelines that staff will follow to handle the situation:

  • Step 1: 1st Verbal or written warning;

  • Step 2: 2nd Verbal or written warning;

  • Step 3: Immediate removal from virtual program component(s). An email will be sent to the parent/guardian explaining the removal of the participant.

These guidelines are intended to create a safe and positive learning environment for all participants. All participants must abide by the Participant Code of Conduct and Virtual Code of Conduct as outlined above. Should a participant not be in compliance with the Code of Conduct, a UHCDC coordinator will report the issues to the parent/guardian. Failure to follow these rules may result in denial of program participation privileges.

WAIVER, RELEASE, INDEMNIFICATION & COVENANT NOT TO SUE

In consideration of my child’s participation in Who Designs Hawaiʻi after school sessions, I, the parent/guardian of the minor named above HEREBY DO RELEASE University of Hawaiʻi and Hawaiʻi Architectural Foundation, its officers, agents, and employees from any causes of action, claims, or demands of any nature whatsoever including, but in no way limited to, claims of negligence, which I may have, now or in the future, against University of Hawaiʻi or Hawaiʻi Architectural Foundation on account of personal injury, property damage, death or accident of any kind, arising out of or in any way related to the participation in Who designs Hawaiʻi programs, whether that participation is supervised or unsupervised, however the injury or damage occurs, including, but not limited to the negligence of University of Hawaiʻi and the Hawaiʻi Architectural Foundation, its officers, agents, and employees.

In consideration of the named minor’s participation in Who designs Hawaiʻi, I, the undersigned parent/guardian of the named minor, agree to INDEMNIFY AND HOLD HARMLESS University of Hawaiʻi and Hawaiʻi Architectural Foundation, its agents and employees from any and all causes of action, claims, demands, losses, or costs of any nature whatsoever arising out of or in any way related to the named minor’s in-person or online participation in Who designs Hawaiʻi sessions.

I hereby certify that I have full knowledge of the nature and extent of the risks inherent in Who Designs Hawaiʻi participation and that I am voluntarily assuming said risks. I understand that I will be solely responsible for any loss or damage, including personal injury, property damage, or death, the named minor sustains while participating in Who Designs Hawaiʻi, and that by signing this agreement I hereby release University of Hawaiʻi Community Design Center and Hawaiʻi Architectural Foundation, its officers, agents, and employees of all liability for such loss, damage, or death.

I, expressly agree that this document is intended to be as broad and inclusive as permitted by the law of Hawaiʻi and that if any portion of the document is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect. Furthermore, I expressly agree that this document shall be governed by and interpreted in accordance with the laws of Hawaiʻi and that the courts of Honolulu county, Hawaiʻi shall be the exclusive venue for any and all disputes relating to or arising from this document.
